Terms and Conditions

Take your time to carefully read and understand our Booking Terms and Conditions outlined below before booking a trip with Tierra Biru Viajes to avoid any inconvenience. You must accept our terms and conditions when making payment through our online payment gateway.

1. The Contract
The contract is made between Tierra Biru Viajes, us, and the Customer, including all individuals named on the booking form. The person signing the booking form ensures they have full authority on behalf of all individuals listed and confirms that all those individuals are aware of and accept these conditions.

2. Deposit Requirement to Confirm a Booking
A deposit of US $300 per person is required to confirm a reservation (non-refundable deposit). All flights (domestic and international) must be paid in full in advance to secure spaces. Cruise reservations are subject to special deposit policies depending on the ship. If the reservation is made 60 days or less before departure, full payment is required.

3. Full Payment and Reconfirmation of Booking
Full payment or the balance must be paid between 60 and 45 days before the trip departure date. As soon as we receive full payment, we will email you confirming your reservation. If the reservation is made 60 days or less before departure, full payment is required. If full payment or the balance is not paid on or before the due date, we reserve the right to treat your reservation as canceled.

4. Cancellation by the Customer
Any cancellation by a Customer must be made in writing and acknowledged by TIERRA BIRU VIAJES EIRL in writing. The date TIERRA BIRU VIAJES EIRL or its travel advisors receive the cancellation request will determine applicable cancellation fees.

a) 70 days or more before departure, non-refundable deposit.
b) 69-31 days; we will retain – 40% of the trip cost.
c) 30-16 days; we will retain – 70% of the trip cost.
d) 15 days or less; we will retain – 100% of the trip cost.

Special notes

  1. Payments or deposits for flight reservations are non-refundable due to airline policies.
  2. In case of postponing the trip, a 20% administrative fee of the trip price plus the amount already spent on non-refundable subcontracted services will be charged. The remaining amount can be used for future trips with TIERRA BIRU VIAJES EIRL.
  3. No refund will be made if you voluntarily leave a trip for any reason after the trip has started. Refunds will be at the discretion of TIERRA BIRU VIAJES if you are involuntarily forced to leave a trip for any reason. No refunds will be made for any unused accommodation, transportation, sightseeing, meals, or services.
  4. It is highly recommended to purchase comprehensive insurance, including coverage in certain circumstances against the loss of the deposit or cancellation expenses.

5. Customer’s Personal Information
For TIERRA BIRU VIAJES to confirm and guarantee the Customer’s travel arrangements, the Customer must provide all Customer Details with their full payment. If the customer does not provide all details 60 days or more before departure, an administrative fee will be charged. In the event that TIERRA BIRU VIAJES has not received the customer’s details 30 days before the Customer’s trip departure, TIERRA BIRU VIAJES reserves the right to treat the file as canceled, and full cancellation fees will apply. Customer details required will vary from tour to tour and will be informed during the booking process. However, at a minimum, customer details include passport number, passport expiration date, full name as it appears on the passport, date of birth, place of birth, nationality, and arrival details (or other documents requested by Tierra Biru Viajes). A reservation may not be confirmed without providing customer data.

6. Cancellations and Changes by Tierra Biru Viajes
a) While Tierra Biru Viajes will do its best to operate all tours as advertised, by entering into this contract, the Customer accepts that it may be necessary or advisable to vary or modify a travel itinerary or its content due to prevailing local conditions.
b) Due to unforeseen and unusual circumstances beyond the company’s control, whose consequences could not have been avoided even with due care. The company will do its best to minimize the effects of matters beyond its control, but it cannot accept any responsibility for these matters, including political disputes, border closures and visa denials, industrial action, delayed flights, unpredictable weather, strikes, war, civil unrest, natural disasters, government actions, mechanical failures, or any force majeure, among others. Tierra Biru Viajes reserves the right at any time to cancel or change any facilities, services, or prices (including flights, accommodation, or other arrangements) and substitute alternative arrangements of comparable monetary value without monetary compensation or refund; and accepts no responsibility for loss of enjoyment as a result of these changes. The customer agrees to bear all extra costs arising from any of these factors.
c) We are not responsible for any additional expenses you may incur as a result of your reservation, such as visas, vaccinations, or non-refundable flights.

7. Payment Methods
a) We accept VISA, MasterCard, AMEX, and Diners Club through this payment method, and no commission is charged.
b) Bank Transfer You can transfer funds directly from your own bank account to our bank account. There is a US $50 administrative fee attached to this account that you must add to the amount you are sending. We will send you our account details upon confirming your trip. Transfer duration to receive: 1 day to 3 days depending on the location from where you send.
c) PayPal We accept payments through PayPal; through this payment method, PayPal charges a 5% commission, and you are responsible for paying it. (Example: initial amount of US $100 + 5% PayPal fee, you must pay US $105).

8. Changes by the Customer
a) For any changes by the customer in the itinerary after receiving a confirmed travel invoice from Tierra Biru Viajes, a change fee of US $40 plus any costs or charges they incur or charge from our suppliers as a result of the amendment will be charged. While all reasonable efforts will be made to accommodate changes and additional requests, their availability cannot be guaranteed.
b) Any changes made by the Customer must be made within 45 business days before the trip departure; otherwise, Tierra Biru Viajes reserves the right to accept or reject suggested modifications based on the availability of tourism companies: accommodations, tour operators, and transportation.
c) Changes to bookings made 44 business days before the trip departure will not be accepted.
d) Any change to the original reservation must be confirmed by the person signing the reservation form.

9. Client Substitution
If any member of your group cannot travel, it may be possible to transfer the reservation to another suitable person, provided written notice is given at least 45 days before departure. A $50 administrative fee plus costs imposed by Tierra Biru Viajes suppliers will be charged. For the Inca Trail, it is not possible to change any information such as dates, name, and passport number after a permit has been processed. A permit is not transferable or refundable. The deposit will be lost 100%. Please note that we do this because we are prohibited from reselling your permit after canceling it.

10. Medical Conditions and Special Requirements
The Customer must notify Tierra Biru Viajes in writing during the booking process of any medical condition, pregnancy, disability, or any other mental or physical condition that may affect fitness to travel or any medical condition. Failure to notify Tierra Biru Viajes may result in the Customer being denied travel. If Tierra Biru Viajes is not notified of any condition resulting in cancellation, the Customer will have to pay full cancellation fees. Some trips may not be suitable for Customers due to age, mobility, disability, pregnancy, or physical or mental conditions. It is the customer’s responsibility to check before booking. Tierra Biru Viajes may refuse to transport pregnant women for 24 weeks or Customers with certain conditions. Tierra Biru Viajes is not obliged to provide special facilities unless it has agreed to do so in writing. Tierra Biru Viajes will do its best to accommodate Customers’ special requests, including dietary, but such requests are not part of the Contract and, therefore, Tierra Biru Viajes is not responsible for not providing these requests. Medical facilities vary from country to country, and Tierra Biru Viajes makes no representations or warranties regarding the standard of such treatment.

Traveling with Children
Customers 18 years old on the date of the first trip are considered adults. One adult over 18 must accompany every 2 children under 18. The ratio of adults to children traveling together should be one adult for every two children and two adults for every four children (17 years or younger). The minimum age for Customers traveling on tours is 12 years (for family-designated tours, the minimum age is 5). All inquiries regarding children are subject to review and approval by Tierra Biru Viajes, which reserves the right to restrict the number of travelers under 18 on tours.

11. Passport, Visa, and Vaccinations

It is the Customer’s responsibility to possess a valid passport and carry it throughout their trip to show at control points required by the destination of visit, visa permits, vaccinations, and preventive medications required for the duration of the tour. Information on these matters or related items is provided in good faith but without liability on the part of Tierra Biru Viajes.

12. Age, Physical Condition, and Participation
a) All Customers are expected to ensure, before booking, that they are fit and able to complete the chosen itinerary. Individuals over 60 years old will be advised to obtain medical evidence of fitness to travel on the chosen itinerary.
b) Unaccompanied minors (under 18) cannot be accepted on tours operated by Tierra Biru Viajes, but older teenagers may be considered if accompanied by a parent or guardian accepting full responsibility for them.
c) Tierra Biru Viajes reserves the absolute right to reject a reservation at its discretion. Customers agree to accept the authority and decisions of Tierra Biru Viajes employees, tour leaders, and travel consultants during the tour with Tierra Biru Viajes.
d) If, in the opinion of such a person, the health or conduct of a Customer before or after departure seems to endanger the safe, comfortable, or happy progress of a tour, the Customer may be excluded from all or part of the tour. In the case of illness, Tierra Biru Viajes may make arrangements it deems appropriate and recover the costs from the Customer.

13. Local Laws
All participants in tours operated by Tierra Biru Viajes are expected to obey the laws and regulations of the countries visited, and any breach will release Tierra Biru Viajes from all obligations they may otherwise have under these booking conditions.

14. Illness or Disability
Anyone suffering from illness or disability or undergoing treatment for any physical or medical condition must declare the true nature of such condition at the time of booking and make arrangements for the provision of any medication or other treatment that may be necessary during the tour. Failure to make such disclosure will constitute a breach of these booking conditions and result in the exclusion of such individuals from the tour, in which case all money paid will be lost. If the chosen holiday includes any form of boat excursion or transfer, the Customer must inform at the time of booking if they cannot swim. This will not prevent the Customer from participating in the tour but will allow Tierra Biru Viajes to take additional precautions for the Customer’s safety at appropriate times.

15. Travel Insurance
Travel insurance is necessary. Tierra Biru Viajes strongly recommends travel insurance to all our travelers. Your travel insurance should provide coverage against personal accidents, death, medical expenses, and emergency repatriation with a recommended minimum coverage of US $100,000 for each of the coverage heads. We also strongly recommend covering cancellation, curtailment, personal liability, and loss of baggage and personal effects. You must provide proof of your travel insurance 15 days before the trip departure. Special Note: In case you do not consider it necessary or do not need travel insurance, you must sign an affidavit stating that you do not need travel insurance, and you will be responsible in case of any inconvenience during the trip.

16. Flight Reservations
a) Tierra Biru Viajes will make every effort to ensure that all flight prices are correct at the time they are quoted. Airlines reserve the right to modify or withdraw fares without prior notice. Once a deposit is paid on an airfare, it ensures that a reservation is made for you, but it DOES NOT GUARANTEE the fare.
b) The fare can only be guaranteed when the flight reservation has been paid in full and a ticket has been issued.
c) Flight reservations cannot be transferred. Flight schedules provided by Tierra Biru Viajes are for general guidance only and are subject to change. Updated flight schedules will be shown on the tickets.
d) The Customer must check the tickets very carefully immediately after receiving the final schedules. Tierra Biru Viajes will strive to inform the Customer as soon as possible in case there is any flight alteration.
e) Airline details are also subject to change. Such alterations do not constitute a significant change to the travel arrangements and, therefore, do not entitle cancellation without paying normal charges as a result.
f) Tierra Biru Viajes is not responsible for any delay in your flight, whether this delay is caused by adverse weather conditions, action by air traffic controllers, airport authorities or governments (local), rescheduling of flight schedules by the airline, mechanical breakdown, strike, industrial action, or any other reason.

17. Customer Responsibility
a) Customers agree to accept the authority and decisions of Tierra Biru Viajes employees, travel leaders, and travel consultants while touring with Tierra Biru Viajes. If, in the opinion of such individuals, the health or conduct of a customer at any time before or after departure appears to endanger the safety, comfort, or happy progress of a tour, then the customer may be excluded from all or part of the tour.
b) In case of ill health, Tierra Biru Viajes may make arrangements it deems appropriate and recover the costs from the customer. If a customer commits an illegal act, he/she may be excluded from the tour, and Tierra Biru Viajes will cease to have any responsibility for him/her. If affected by a condition, medical or otherwise, that could affect the enjoyment or active participation of the tour by others, you must inform us at the time of booking.
c) No refund will be granted for unused services. Customers must possess a passport to show at control places they will visit and are responsible for obtaining a valid passport, visa if applicable, and vaccination certificates required for the entirety of their trip. Information about these matters or related items (climate, clothing, luggage, etc.) is provided in good faith, but Tierra Biru Viajes is not responsible for this information.

18. Tierra Biru Viajes Responsibility.
a) Tierra Biru Viajes organizes on behalf of our travelers, under their names, transportation, accommodation, meals, and other required tourist services. Therefore, we are not responsible in case of accidents, loss of personal effects during the subcontracting of services such as during the services of the Tour Guide, on the bus, in hotels, in restaurants, during walks, camping, etc. delays or interferences with the tour, due to the force of major reasons for which we have no direct responsibility.
b) Tierra Biru Viajes is not responsible for illness, maternity, physical or mental disabilities that may endanger the health or integrity of the traveler or third parties during the tour. We will not assume any claim or refund for the aforementioned reasons.
c) Tierra Biru Viajes will not pay compensation if forced to cancel or change your tour due to war, threat of war, riots, civil conflicts, industrial disputes, natural disasters, fires or adverse weather conditions, epidemics or health risks, technical or maintenance problems with transportation, closed or congested airports or ports, changes imposed by airline rescheduling or flight cancellations, alteration of airlines or types of aircraft, or similar events beyond the control of Tierra Biru Viajes.
d) Tierra Biru Viajes will not accept liability for changes in the flight schedule or departure airport, as this is the airline’s responsibility. However, we will strive to minimize their effects on your trip. We cannot accept responsibility for delays in any of your flights, whether the cancellation or delay is caused by adverse weather conditions, airline rescheduling, airport authority, and/or air traffic controller action, mechanical breakdown, or industrial action. When prolonged flight delays result in lost holiday time, hotels or providers do not offer refunds. Similarly, airlines do not offer compensation for flight delays. However, at their discretion, carriers will endeavor to reduce inconvenience from any delay by providing meals and accommodation, as appropriate to the time of day or night (subject to local availability). If you make payments for such services in case of delay.

19. Financial Security
Tierra Biru Viajes is a travel agency accredited by the Ministry of Tourism in Peru and is a Tour Operator licensed by the Ministry of Foreign Trade of Peru (DIRCETUR), requiring full indemnity insurance and full bond to comply with all laws related to the international travel business. Our company registration number (RUC) is 20601304253. Tierra Biru Viajes is an official Inca Trail operator with a license accredited by SERNANP. We are a Local Tour Operator with an office in Cusco, Peru, an Authorized and Licensed Tour Operator by the Ministry of Foreign Trade and Tourism of Peru under TIERRA BIRU VIAJES EIRL Tour Operator; we do not own vehicles, lodgings, hotels, restaurants, etc. Instead, we carefully select local operators in Lima, Arequipa, Puno, Ica, Amazon, Trujillo, etc., and facilities with whom we want to work and trust, based on our 10 years of experience.

20. Photographs and Testimonials
If we secure or take any image of you during the tour, we have the right to use it in our advertising campaigns without any charge. This includes all types of promotional material such as slides, video programs, brochures, and the Internet. If you have provided us with any written comments, it may also be used for promotional purposes.

21. Privacy Policy
The company will use the personal information you provide to us to make all travel arrangements. As such, we will need to transmit it to our providers and carriers to enable the operations of the services you have requested. However, we will strive to protect your information and use it for official purposes only as extremely necessary. I have taken enough time to read the Booking Terms and Conditions. I have fully understood all clauses and give my complete consent to all of them.
